An NEC3 Problem
This family suite of NEC3 has been in use in the Construction Industry (and perhaps other industries) for more than 25 years now and I am amazed and at the same time perplexed by the little understanding on the application this form by experienced, and lesser experienced, practitioners.The number of projects procured under NEC3 in my experience is quite high, but more often than not the parties that have signed up to it wants nothing to do with it. The risk of ignorance, again in my experience, is absolutely not worth it.
Indeed, it is scary stuff when things go wrong and people then wish to retrospectively rely on it and realise that no one can actually rely on any of the provisions or conditions to bash the other as neither side had complied with the many prerequisites to contract bashing in the first place.
As I said scary stuff!
